Starbucks to donate to RED for World AIDS Day

(AP) ? Starbucks Corp. is donating a portion of its proceeds on World AIDS Day to help fight the disease.

The company announced Thursday it would give five cents to the Global Fund of the RED foundation for each hand-crafted drink it sells on Saturday in the United States and Canada. The coffee shop is also partnering with iTunes, offering a digital $30 gift card that is divided into two $15 certificates to iTunes and Starbucks. Five percent of the proceeds to those gift cards, sold online, will also be donated to RED.

RED was founded by Bono and Bobby Shriver and links with brands to help raise money to fight AIDS. It benefits the Global Fund, which uses the money for HIV/AIDS programs in Africa.

Myanmar cracks down on mine protest; dozens hurt

MONYWA, Myanmar (AP) ? Security forces used water cannons, tear gas and smoke bombs Thursday to clear protesters from a copper mine in northwestern Myanmar, wounding villagers and Buddhist monks in the biggest use of force against demonstrators since the reformist government of President Thein Sein took office last year.

Opposition leader Aung San Suu Kyi, who arrived in the area hours later on a previously scheduled visit, said she would try to negotiate a solution.

In a statement broadcast on state television, the government initially acknowledged using the riot-control measures but denied using excessive force. In an unusual move, it later retracted the statement without explanation.

Monks and other protesters had serious burns after the crackdown at the Letpadaung mine near the town of Monywa. Protesters who oppose the mine's impact on villagers and the environment had occupied the area for 11 days.

"I didn't expect to be treated like this, as we were peacefully protesting," said Aung Myint Htway, a peanut farmer whose face and body were covered with black patches of burned skin.

The police action risks becoming a public relations and political fiasco for Thein Sein's government, which has been touting its transition to democracy after almost five decades of repressive military rule.

"This is unacceptable," said Ottama Thara, a 25-year-old monk who was at the protest. "This kind of violence should not happen under a government that says it is committed to democratic reforms."

Police moved early Thursday to disperse protesters after some heeded earlier warnings to leave.

"Around 2:30 a.m. police announced they would give us five minutes to leave," Aung Myint Htway said. He said police fired water cannons first and then shot what he and others called flare guns.

"They fired black balls that exploded into fire sparks. They shot about six times. People ran away and they followed us," he said, still writhing hours later from pain. "It's very hot."

Photos of the wounded monks showed they had sustained serious burns on parts of their bodies. It was unclear what sort of weapon caused them, or whether the burns were caused by their shelters catching fire from whatever devices police used.

The government had defended its actions in a statement issued by the government's official information office Thursday afternoon. It denied using excessive force and said it used fire hoses, tear gas and smoke bombs according to international standards for riot control. The statement declared that the authorities took action for the sake of rule of law and in the interests of the country and its people, and said the project operated in accordance with international environmental standards.

Later, however, the president's office issued a one-sentence statement recalling the information office's statement without explanation. The move may reflect sensitivities over the injuries monks suffered, or second thoughts over admitting that authorities used force.

Suu Kyi's visit to nearby Kan-Kone village had been scheduled before the crackdown. The Nobel Peace laureate, elected to parliament after spending most of the last two decades under house arrest, unexpectedly went to the mine to meet with its operators before making her speech.

"I already met one side. I met with mine operators. I want to meet with villagers and protesters," she said. "I want to negotiate hearing from both sides."

She asked the crowd to be patient. "I haven't made any decision yet. I want to meet with both sides and negotiate," she said in a speech that lasted less than 15 minutes. "Will you agree with my negotiating?" The crowd shouted its assent.

Some of Suu Kyi's comments suggested that she may not fully embrace the tactics of the protesters. "When dealing with people, I don't always follow what people like. I only tell the truth," she said. "I will work for the long-term benefit of the country."

After her speech she went to the hospital where many of the injured were being treated, and met with protest leaders at the hotel in Monywa where she is staying. Thwe Thwe Win, a female protest leader, said afterward: "We will wait for Aung San Suu Kyi to negotiate with the companies. But we will not stop the protest until we achieve our demands, though I cannot tell you how we will proceed at this point."

Ohn Kyaing, a spokesman for Suu Kyi's National League for Democracy party, said she told the mine's executives that force should not have been used. He said the executives said they did not direct the action, and that it had been the work of the state security forces. Ohn Kyaing said Suu Kyi on Friday would meet with officials in charge of the crackdown, as well as local villagers and their representatives.

Villagers affected by the mine claim they did not receive satisfactory compensation and demand a more comprehensive environmental impact assessment.

The mine, which is being expanded, is a joint venture between a Chinese company and a holding company controlled by Myanmar's military.

Most people remain suspicious of the military, while China is widely seen as having propped up army rule for years, in addition to being an aggressive investor exploiting the country's many natural resources.

Government officials had publicly stated that the protest risked scaring off foreign investment that is key to rebuilding the economy after decades of neglect.

State television had broadcast an announcement Tuesday night that ordered protesters to cease their occupation of the mine by midnight or face legal action. It said the protesters began occupying the mine area Nov. 18, and operations had been halted since then.

Some villagers among a claimed 1,000 protesters left the mine after the order was issued. But others stayed through Wednesday, including about 100 monks.

The protesters' concerns about the mine do not yet appear to be widely shared by the broader public. But hurting monks ? as admired for their social activism as they are revered for their spiritual beliefs ? is sure to antagonize many.

Aung Myint Htway said he didn't care that police treated him badly but added, "I won't forgive them for what they did to our monks."

According to a nurse at a Monywa hospital, 27 monks and one other person were admitted with burns caused by some sort of projectile that released sparks or embers. Two monks with serious injuries were sent for treatment in Mandalay, Myanmar's second-biggest city, a 2? hour drive away.

Other evicted protesters gathered at a Buddhist temple about 5 kilometers (3 miles) from the mine's gates.

The protest is the latest major example of increased activism by citizens since the elected government took over last year. Street demonstrations have been legalized, and are generally tolerated, though detentions have occurred in some cases involving sensitive issues.

Political and economic liberalization under Thein Sein has won praise from Western governments, which have eased sanctions imposed on the previous military government because of its poor record on human and civil rights.

However, the military still retains major influence over the government, and some critics fear that democratic gains could be rolled back.

The government's surprise suspension last year of a Chinese-backed hydroelectric project, in response to similar concerns about social and economic consequences, was seen as a significant indicator of its commitment to democratic reform. But China was unhappy about the decision, and Thein Sein's ministers have warned about offending Myanmar's big neighbor to the north and scaring off other foreign investors.

China's foreign ministry defended the mining venture Thursday as mutually beneficial and said that environmental remediation and compensation to relocate affected residents all conformed to Myanmar law.

Like many throughout the country, villagers near the project are keen to have Suu Kyi involved.

"We feel really encouraged when we heard Mother Suu is coming," said Sartone village resident Thein Thein, using a popular familiar term for Suu Kyi. "She's our only hope."

Suu Kyi, however, recently told Myanmar reporters that not everything should be resolved through demonstrations, and sometimes it is better to use negotiations.

"Everyone can relate to the Messiah, even beyond Christianity on some level," she added. "I think that's why Jennens is so instrumental."

Jennens, whose family fortune came from iron, was a friend of Handel and a major backer, subscribing to his music and providing the texts for "Saul", "Belshazzar", "L'Allegro, il Penseroso ed il Moderato" and probably "Israel in Egypt".

So important did Handel consider Jennens that he referred to "your oratorio Messiah" in a letter to the librettist and made a detour on his way home from its premiere in Dublin to visit Jennens and tell him of its success with audiences.

The exhibition, "The Man Behind Messiah", includes Handel's autographed score of Saul which Jennens also annotated, suggesting changes to the composer's work including a different entry point for the words "impious wretch".

Yet Jennens' name never appeared on scores, helping to explain why his contribution is largely unknown. An intensely private man, Jennens had reasons for remaining anonymous.

As a "non-juror", or someone who did not endorse the Hanoverian royal dynasty that succeeded the House of Stuart, he was effectively barred from holding positions of authority.

And when, late in life, he published groundbreaking single-volume editions of some of Shakespeare's most famous plays, he was attacked by a rival, Shakespearean commentator George Steevens (Eds: correct), and, thus, once again overlooked.

"It's another reason he becomes kind of cut out of history," Bardwell explained. "It's been a fascinating insight into how people can just be written out of history."

Ironically, despite his fundamental role in the Messiah and some of Handel's other great oratorios, Jennens was not the biggest fan of a work that took less than a month to compose.

"He just thought Handel maybe rushed it off too quickly," said Bardwell. Ruth Smith, the curator of the exhibition, believes Handel had the manuscript for about 18 months before he started work on it.

"For it to be rattled off in three weeks, I think Jennens felt that maybe he hadn't done himself justice.

"I don't think he ever quite got over his opinion that it wasn't as good as he had hoped it was going to be. I think that also doesn't help his reputation. I'm not sure he ever quite recovered from that."

The Man Behind Messiah runs until April 14, 2013.

THOUSAND OAKS, Calif. (AP) ? Webb Simpson and Keegan Bradley, two of the major faces in the debate over belly putters, said Tuesday they would not fight a change in the rules if golf's governing bodies decide to outlaw putters anchored to the body.

That doesn't mean they're in favor of a ban.

"I'm obviously not happy with the ruling, but I respect the USGA, and especially Mike Davis," Bradley said. "They make the rules, and I'll adjust appropriately. But I'm going to accept the challenge and hopefully do well when they do ban it."

Davis, the USGA executive director, and Royal & Ancient chief executive Peter Dawson have scheduled a press conference Wednesday morning to announce their conclusions on the future of long putters. All indications point toward a ban on anchoring the club.

At issue is not the putter itself, but whether it can be anchored to the body, such as the stomach (belly putters) or the chest (long putters).

The long putters have been in vogue for the better part of 25 years, though a recent surge in use got the attention of golf's two governing bodies. Bradley became the first major champion with a belly putter when he won the PGA Championship last year. Simpson won the U.S. Open using a belly putter, and Ernie Els won the British Open with a belly putter, rallying to beat Adam Scott, who uses a long putter he anchors to the top of his chest.

Guan Tianling, the 14-year-old from China, used a belly putter to win the Asia-Pacific Amateur earlier this month to earn a spot in the Masters.

Dawson spoke in July about looking at the anchored putters as a rules issue instead of an equipment issue. If that's the case and it is banned, it would not take effect until 2016 because the Rules of Golf are only updated every four years.

While a change would affect players like the recent major champions, Carl Pettersson and Tim Clark, several others are opposed to putters stuck into the body. They argue it takes away nervous hands and allows for a smoother stroke.

Tiger Woods is opposed to long putters, and he stated his argument clearly on Tuesday.

"I just believe that the art of putting is swinging the club and controlling nerves, and having it as a fixed point ? as I was saying all year ? is something that's not in the traditions of the game," Woods said. "We swing all other 13 clubs. I think the putter should be the same. It should be a swinging motion throughout the entire bag."

Woods said his biggest concern was not so much the major champions, but junior players.

"There have been some guys who had had success out there, and obviously everyone always copies what we out here, and that's something that I think for the greater good of the game needs to be adjusted," he said.

Simpson first switched to a belly putter in 2004 to help with consistency. He found one in a pro shop, gave it a try and noticed immediate improvement. But for all the attention on belly putters, he said it was the accuracy with his driver that helped him win the U.S. Open at Olympic Club this year.

"My argument the whole time is to change something that drastic, it needs to be based off facts and not what certain people think the tradition of the game looks like," Simpson said. "But look, I'm not going to be one of those guys that says this is a terrible decision. I'm just saying to make a change this big, show me the facts. And hey, they're the governing body, so we'll see what happens."

Simpson already has been practicing with a conventional putter, preparing for such a ban. He said if there is a ban, he would use the conventional putter at home, and then in pro-am rounds and make the switch when he's comfortable with it.

"I'm just going to take it one step at a time until my comfort level gets better and better," Simpson said. "If I feel ready by Hyundai (the start of the 2013 season), I'll be putting with a short putter. And if I don't feel ready for two years, I'll wait."

Bradley said he would be in no rush to make the change if there is a ban.

Graeme McDowell and Ian Poulter were among those who lined up against anchored putters earlier this month in Australia. McDowell said the rule should have been changed years ago, and that using an anchored putter "takes one extraneous movement out of the putting stroke," which he feels is an advantage under pressure.

Poulter, as usual, was more blunt.

"Ban it. End of story," Poulter said.

Steve Stricker, regarded as one of the best putters in golf, has picked up a belly putter to see what the rage was all about. And it concerned him.

"It was pretty scary how fast I picked it up, to tell you the truth," Stricker said. "I went and anchored it just right below my sternum. It was a little different feel for me, but I got pretty consistent pretty quick with it. So I can see that there was an advantage, even though I can't see myself ever doing it."

Spain's rescued banks to shrink, slash jobs

BRUSSELS/MADRID (Reuters) - Spain's four nationalized banks will more than halve their balance sheets in five years, slash jobs and impose hefty losses on bondholders, under plans approved by the European Commission on Wednesday.

The measures open the door for nearly 40 billion euros ($52 billion)in euro zone bail-out funds for the state-rescued banks, offering hope for an end to Spain's banking crisis which has pushed the country to the brink of asking for sovereign aid.

The approval sets in place one of the most far-reaching over-hauls of any European banking system ordered by the Commission since the start of a banking crisis in mid-2007 with the near collapse of German lender IKB.

"Our objective is to restore the viability of banks receiving aid so that they are able to function without public support in the future," said European Union Competition Commissioner Joaquin Almunia said.

Bankia, NCG Banco, Catalunya Banc and Banco de Valencia were taken over by the Spanish state after unsustainable lending during the country's decade-long property boom left the lenders dangerously short of capital.

The smallest of the four banks, Banco de Valencia, will be sold to one of Spain's healthiest lenders Caixabank, while the other three banks must cut their balance sheets by more than 60 percent over the next five years.

JOB LOSSES

It was cheaper to sell Banco de Valencia under a loss protection scheme than to wind it down, the Commission said. Spain will sell NCG Banco and Catalunya Banc within 5 years or liquidate them.

Almunia said the nationalized banks would have to close up to half their branches during the five-year overhaul process.

The biggest of the banks, Bankia, said it would lay off over a quarter of its workforce amounting to over 6,000 staff, reduce its branch network by around 39 percent and aim to return to profitability by 2013.

Bankia, formed from the merger of seven savings banks in 2010, said holders of hybrid debt would contribute up to 4.8 billion euros to the recapitalization, through losses incurred by swapping their holdings for shares.

The European Commission said the cost to hybrid and subordinated bondholders in the restructuring of the nationalized banks will come to about 10 billion euros.

Many hybrid debt holders at the nationalized banks are retail customers who say they were conned into buying complex financial instruments that buoyed banks' capital levels instead of fixed-term savings accounts.

The Commission said it would ensure the banks use no more taxpayers' money than necessary and that they do not go back to unsustainable business practices.

The Commissioner said he would decide on other Spanish banks with capital shortfalls on December 20.

The approval allows the euro zone to disburse the funds from its permanent ESM bailout fund. Spain was given approval to receive up to 100 billion euros from the ESM in the summer.

People with depression or other mental illnesses often report trouble sleeping, daytime drowsiness and other sleep-related issues. Now a growing body of research is showing that treating sleep problems can dramatically improve psychiatric symptoms in many patients.

Much of the latest work illustrates how sleep apnea, a common chronic condition in which a person repeatedly stops breathing during sleep, may cause or aggravate psychiatric symptoms. In past years sleep apnea has been linked to depression in small studies and limited populations. Now a study by the Centers for Disease Control and Prevention strengthens that connection. The CDC analyzed the medical records of nearly 10,000 American adults with sleep apnea. Men diagnosed with this disorder had twice the risk of depression?and women five times the risk?compared with those without sleep apnea. Writing in the April issue of Sleep, lead author Anne G. Wheaton and her colleagues speculate that in addition to interrupting sleep, the oxygen deprivation induced by sleep apnea could harm cells and disrupt normal brain functioning.

Treating this disorder shows promise for reducing symptoms of depression, a recent study at the Cleveland Clinic suggests. In the experiment, patients went to bed wearing a mask hooked up to a machine that increases air pressure in their throat. The increased pressure prevents the airway from collapsing, which is what causes breathing to cease in most cases of this disorder. Using this machine, psychiatrist Charles Bae and his colleagues treated 779 patients who had been diagnosed with sleep apnea. After an average of 90 days of sleeping with the machine, all the patients scored lower on a common depression survey than before the treatment?regardless of whether they had a prior diagnosis of depression or were taking an antidepressant. Razer Gaming Keyboards are Full-Featured for Serious Play [REVIEW]

If you find yourself spending a lot of time on your PC gaming but you?re still using a regular keyboard, you may get frustrated. For those looking for a serious keyboard for their gaming lifestyle, Razer has two unique products for you.

The two newest Razer gaming keyboards are decidedly high end. The Razer BlackWidow and Razer DeathStalker Ultimate both offer a variety of features for gamers who want to play more accurately and comfortably.

The BlackWidow

The Razer BlackWidow, pictured above, is a mechanical gaming keyboard. You don?t really appreciate mechanical keyboards until you?ve used them for a while: Every key is its own independent switch, as opposed to most modern keyboards, which are set on a membrane. This independence means you don?t have to press down the key as far for it to register, and that the keyboard just feels better for typing.

One downside of this is that you?ll hear each key clack as you type, so in hot and heavy gaming moments your keyboard will be very loud. This may not make you very popular if you are using voice chat while gaming (as I found out first hand). That?s not a fault of this keyboard in general, but something that?s very important to know before purchasing any mechanical keyboard.

The Razer BlackWidow feels stable to use because of its mechanical keys, and because it weighs over 3 pounds. You never feel like it will slide around as you?re typing or playing. The keys are also very easy to see as well ? it comes in backlit varieties, though the model I tested just had high-contrast letters. There is also an audio out and mic in line attached, as well as a USB patch cable so you gain more ports, meaning it integrates well into your gaming setup.

This keyboard can also quickly record macros, which are single keystrokes that can function as multiple key presses. It can record onto 10 profiles that pair with your most often-played games. There?s also the handy ?gaming mode? that disables the Windows Key and Alt-Tab, so you don?t accidentally switch out of whatever you?re playing.

The Razer BlackWidow retails for $125, and it quickly becomes easy to see why you?d want to spend the money after switching back to a normal keyboard. It?s a great complement to whatever you?re doing on your PC.

DeathStalker Ultimate

The Razer DeathStalker Ultimate is the most customizable keyboard I?ve ever encountered. It?s a bigger than average keyboard ? it includes a built-in wrist rest and an extra section with 10 buttons and a 4-inch touchpad that doubles as an LCD screen on the right side.

The customization starts when you install Razer?s Synapse 2.0 software, which allows you to change all the settings of your keyboard. You can start by tweaking the look: The individually backlit keys will glow with any color you can think of, or even cycle through colors for a particularly psychedelic effect. The touchpad?s LCD screen is the same way: You can program it to display any image you can snag off the internet or your hard drive.

The 10 top-row keys are completely customizable, and I mean completely. You can set them to open any application on your computer or do any in-game actions. You can also decorate these with any image you want. Similar to the BlackWidow, you can switch between 10 profiles depending on what you?re using the keyboard for. There are also built-in profiles for games like Mass Effect 3, Star Wars: The Old Republic and Team Fortress 2. Players can also crank up the brightness to easily see what buttons they?re hitting.

The DeathStalker Ultimate also includes the same macro and programmable button features from the BlackWidow, along with the ability to shut off your Windows Key.

The touchpad and extra keys also have some cool-but-less-useful features, too. You can launch a tiny Facebook browser on the LCD screen, or YouTube, all through the keys. While it was easy to navigate through YouTube?s menus ? thanks to the 10 bonus keys transforming into its most needed features ? I have to wonder why you?d need to watch cat videos on a tiny screen while playing your game. The touch pad was also great and responsive, but I couldn?t find myself using it much.

Unlike the BlackWidow, the DeathStalker Ultimate is not a mechanical keyboard ? it?s a low-profile keyboard with soft keys. It also has an included, non-removable wrist rest that makes it feel a bit like a laptop. Another important hardware note is the keyboard requires two USB ports to function, so it might be tricky for anyone who uses a gaming laptop with an external keyboard, mouse and monitor. There was no USB pass-through like the BlackWidow, so this is really going to be the most functional for someone with at least 4 USB ports.

The $250 price tag is easy to balk at if you don?t need a high level of customization in your keyboards, but for those who want to be able to tweak and access every part of their hardware, the DeathStalker is the way to go.

Why a national online sales tax may not pass | Constitution Daily

If you start seeing new taxes on your online purchases, it?s not a mistake. States are asking some web sellers to collect taxes, despite a Supreme Court ruling. But the issue is far from settled in Congress and the courts.

The giant online retailer Amazon is in the process of charging Internet shoppers in some states for sales and use taxes for products purchased online, based on where they live.

Amazon is voluntarily charging the taxes as part of an agreement with some state governments in an effort to avert lengthy litigation. Amazon also maintains distribution facilities in some states.

Other online sellers, like eBay and Overstock, are strongly opposed to current efforts to implement online sales and use taxes. Facebook, Yahoo! and AOL are also part of an industry group called NetChoice, which opposes such measures as restrictive to small business.

In the past, online businesses cited a 1992 Supreme Court ruling, Quill Corp. v. Heitkamp, as proof that websites and online retailers don?t have to charge?and collect?sales taxes in states where they don?t have a physical business.

Quill was an out-of-state main-order house that sold products without having a store or sales staff in North Dakota.

The Supreme Court found that states had a right under the Due Process Clause of the Constitution to collect sales taxes, but the burden placed on out-of-state businesses violated the Commerce Clause.

?The State?s enforcement of the use tax against Quill places an unconstitutional burden on interstate commerce,? said Justice John Paul Stevens.

The court then placed the ball in the court of Congress, saying that the ?underlying issue here is one that Congress may be better qualified to resolve, and one that it has the ultimate power to resolve.?

Two decades later, bipartisan support grew within Congress this summer of the national enforcement of sales and use taxes in the 45 states that assessed them.

The requirement of any national online sales tax measure would be to streamline the process used by any company to collect sales and use taxes across 45 states, so it isn?t a burden to conducting business.

In a tough economic climate, states want the tax revenue from online sales. Some states, like Pennsylvania, are requiring that tax payers estimate what they buy online each year as part of an annual use tax.

The National Conference of State Legislatures estimates that online sales taxes, if enforced nationally, could bring in $23 billion a year for such states.

One problem stalling congressional action is deciding on how such a bill would affect small businesses.

The primary piece of legislation is the Marketplace Fairness Act, proposed by three senators: Richard Durbin (D-Illinois), Mike Enzi (R-Wyoming) and Lamar Alexander (R-Tennessee). It would exempt a business making less than $500,000 a year from collecting sales and use taxes.

Steve DelBianco, the executive director of NetChoice (the industry group opposed to the current efforts), told the Senate in August that a proposed streamlined tax-collection process would add to the costs and complexity of running a small business.

?Congress should not sweep Quill aside without first requiring that states truly simplify their tax systems in an accountable way, while providing adequately protection for America?s small businesses,? he said.

Supporters of efforts such as the Streamlined Sales and Use Tax Agreement, which has been adopted by 24 states, say it?s an issue of fairness, in addition to states losing out on tax revenue.

The key issue is how effectively a computerized system can be established to collect taxes not only from 45 states and the District of Columbia, but also additional local sales taxes, and get the revenue in the hands of the correct people, without imposing a huge cost on small business.

The Marketplace Fairness Act will likely face challenges in Congress before it could become a law, and then face a whole new set of legal challenges if it is passed.

A top lobbyist told The Hill that the three top supporters of the Marketplace Fairness Act will try to get the law passed before January.

David French, from the National Retail Federation, said the task will be much tougher in the House than the Senate.

Senator Jim DeMint (R-South Carolina), a powerful senator aligned with the tea party, is a vocal, public opponent of the Marketplace Fairness Act.

?If states want more taxes, they can raise taxes on their residents, but it?s antithetical to our federalist system to let states raise taxes on out-of-state residents,? DeMint said in editorial in U.S. News & World Report in August.

?Call this legislation what it is: A nationally-mandated Internet tax on small business. It?s anything but fair,? he said.

The Hill says DeMint had put the bill on his lame-duck watch list for December.

Another person on record as opposing the Marketplace Fairness Act, although not as vocally as DeMint, is Grover Norquist from the Americans for Tax Reform.

The bill?s supporters have presented the law as a states? rights issue, which may help it get some traction, and as an effort to collect taxes and close tax loopholes. In fact, the introduction of the bill calls it an effort ?to restore States? sovereign rights to enforce State and local sales and use tax laws, and for other purposes.?

But passing the bill will be tricky in a potentially super-charged political climate after a general election and during fiscal cliff negotiations.

And the appearance of a tax hike on small businesses and consumers, even if it is presented as closing a tax loophole, will get a lot of attention in the online community.

Pasta de Waraku is one of my favorite places for having fusion Japanese pasta and pizza. I was pretty?intrigued? when I received an invitation from Pasta de Waraku to try their?new special menu - Indonesian Feast with a Twist, which they claimed as a unique twist to Japanese dishes with the richness of Indonesian taste that will tantalize the buds.

Sandy exposes Fire Island shipwreck

A wrecked schooner long buried on Fire Island ? a barrier island off of Long Island, N.Y. ? now lays fully exposed following Hurricane Sandy's attack on the beach.

The weathered hull of the shipwreck lies about 4 miles (6 kilometers) east of Davis Park, between Skunk Hollow and Whalehouse Point, in the Fire Island National Seashore, as first reported by Newsday.?

The remains are thought to be the Bessie White, more than 90 years old, said Paula Valentine, public affairs specialist for the park. Historic photographs and news accounts don't agree on the year of the ship's grounding, but here is an outline of its story:

The ship, a four-mast Canadian schooner, went aground in heavy fog about a mile west of Smith's Point, Long Island, in either 1919 or 1922. The men escaped in two boats. One capsized in the surf, injuring one crew member, but everyone (including the ship's cat) made it to shore safely. But the crew couldn't save the 3-year-old ship or its tons of coal. The ship was salvaged in the following weeks.

The bus-size ship's skeleton has poked up through the sand before, such as after a nor'easter in 2006, exposing long boards and metal pegs, Valentine told OurAmazingPlanet.

The dune that used to bury the wreck eroded back an average of 72 feet, said U.S. Geological Survey coastal geologist Cheryl Hapke, who is studying the changes on Fire Island.

Archaeologists and park officials are documenting the shipwreck before the sea reburies it with sand, Valentine said.

"There's so little of it left we may not be not be able to determine which ship it actually is, but we may be able to learn more about its age," she said. "It's just a rare treat to see something exposed."

Fire Island is a barrier island, a natural system that takes the brunt of the damage during powerful hurricanes and winter storms.

Browns cornerback Joe Haden will be a game-time decision after injuring his oblique muscle in practice on Wednesday. Defensive tackle Ahtyba Rubin, who has missed three of the last four games, is also questionable. If both are out, it won?t look good for the Browns defense. Running back DeMarco Murray is doubtful, so the Cowboys will likely be without him again this week. Defensive end Sean Lissemore, safety Matt Johnson and center Phil Costa are all out and cornerback Mike Jenkins is doubtful.

Jets at Rams

Wide receiver Jeremy Kelley didn?t practice on Friday and is listed as questionable for the game in St. Louis. Running backs Bilal Powell and Joe McKnight, defensive tackle Sione Po?uha and linebacker Bart Scott are also questionable. Coach Rex Ryan said he expects all of them to play. The Rams are looking pretty healthy, with wide receiver Austin Pettis standing as the biggest name among four questionable players.

Eagles at Redskins

You?ve likely heard that quarterback Michael Vick is out for this one. Wide receiver Jason Avant has also been ruled out, which means the Eagles? emergency quarterback for Sunday is reportedly DeSean Jackson. Wide receiver Pierre Gar?on and safety Brandon Meriweather are both likely to play for the otherwise healthy Redskins.

Packers at Lions

The Packers have known for some time that they are going to be without linebacker Clay Matthews, cornerback Charles Woodson and wide receiver Greg Jennings. Cornerback Sam Shields and linebacker Terrell Manning are both questionable for Green Bay. The Lions have ruled out defensive tackle Corey Williams and safety Amari Spievey. Louis Delmas is also doubtful, which would leave the Lions short in the secondary against a team that you?d rather not face when you?re short in the secondary. Cornerback Chris Houston and wide receiver Calvin Johnson are both questionable after practicing on Thursday and Friday.

Jaguars at Texans

The Jaguars started off the week by ruling out running back Maurice Jones-Drew and ended it by doing the same with cornerback Rashean Mathis, defensive back Dwight Lowery and linebacker Greg Jones. Tight end Owen Daniels will be a game-time decision again this week after not being able to play in the win over the Bears. Running back Ben Tate?s been ruled out, while linebacker Tim Dobbins and defensive tackle Shaun Cody are both questionable.

Bengals at Chiefs

It doesn?t look like Bengals will have wide receiver Marvin Jones or safety Reggie Nelson as both are doubtful, but there?s still a chance for center Jeff Faine and wide receiver Andrew Hawkins. Guard Jon Asamoah and wide receiver Jonathan Baldwin are both out for this week?s game. Center Ryan Lilja and quarterback Brady Quinn are both questionable, although it looks like Matt Cassel will start again this week.

Saints at Raiders

The Saints have a chance at getting running back Darren Sproles back in the lineup, but they won?t have tackle Zach Strief again this week. The Raiders will be without defensive tackle Richard Seymour and running backs Darren McFadden and Mike Goodson again this week. They?ll make a determination about safety Tyvon Branch and wide receiver Darrius Heyward-Bey before the start of the game.

Chargers at Broncos

Chargers tackle Jared Gaither hasn?t been ruled out, he?s doubtful to play, but defensive tackle Aubrayo Franklin won?t play. Running back Ryan Mathews returned to practice Friday after missing two days with a neck injury and is listed as questionable. Broncos defensive end Elvis Dumervil is also questionable while cornerback Tracy Porter is out and guard Chris Kuper probably will be.

Colts at Patriots

The Colts ruled out cornerback Vontae Davis and tight end Coby Fleener were ruled out earlier in the week and the rest of the players on their injury report are probable. The Patriots? injury report is, as always, filled with questionable players everywhere you look. Tight end Aaron Hernandez is one of them, although reports are that he will not play, and guard Logan Mankins breaks the mold by earning a doubtful designation.

Ravens at Steelers

Cornerback Jimmy Smith?s been knocked out by sports hernia surgery and the Ravens could also be without a pair of defensive linemen. Defensive end Pernell McPhee is doubtful and defensive tackle Terrance Cody is questionable. The Steelers will be without quarterback Ben Roethlisberger, wide receiver Antonio Brown, tackle Marcus Gilbert and safety Troy Polamalu. Safety Ryan Clark is probable after suffering a concussion on Monday night, as is running back Rashard Mendenhall.

Michigan Rejects Expanded Energy Mandate

Michigan voters rejected a proposed state constitutional amendment last week that would have imposed a mandate requiring the state?s utilities to source 25 percent of their electric sales annually from renewable energy by 2025.

Proposal 3, dubbed ?25 by 25,? called for more renewable energy from wind, solar, biomass, and hydropower, while setting price caps to control expected rate increases caused by compliance with the new standard.

The amendment would have exceeded current renewable energy standards imposed by the state. Michigan currently seeks to reach 10 percent renewable energy by 2015, due to a law passed in 2008.

The overwhelming defeat came despite millions from an out-of-state ballot committee Michigan Energy Michigan Jobs (MEMJ) that was opposed by in-state utilities, as Scribe?s Lachlan Markay wrote in the Washington Examiner:

Of the $11.1 million MEMJ has collected in 2012, about 85 percent has come from major environmental advocacy groups, including, in order of magnitude, the League of Conservation Voters, the Green Tech Action Fund, the BlueGreen Alliance, the American Wind Energy Association, the Natural Resources Defense Council, the Environmental Law and Policy Center, the Environmental Defense Action Fund, the Regeneration Project and the Union of Concerned Scientists. The only individual donor to give MEMJ more than $1,000 is millionaireNew Yorkhedge fund manager Julian Robertson, who gave $1 million?

Michiganutilities DTE Energy and CMS Energy (directly and through subsidiary Consumers Energy) are providing about 95 percent of the $25 million in funding on the other side, through a ballot committee called the Clean Affordable Renewable Energy for Michigan Coalition.

Regardless of the massive one-time expense by both parties, the mandate?s continuing expense on individuals and businesses was a key reason Michiganders turned Prop 3 down 63 percent to 37 percent.

The Heritage Foundation?s Katie Tubb examined some of the impending costs of the amendment?s passage, which aside from being rash energy policy functions as a giant energy tax:

Nearly every service and product depends on electricity and when prices go up it affects the entire economy. Though the magnitude of net economic impacts differ [across studies], the direction is clear: mandating specific energy sources, rather than introducing efficiency, slows the economy. Electricity prices go up, incomes and employment go down, and the effects of a mandate escalate as the milestones built into the mandate become steeper. As it is,Michigan has over 70 percent of their current mandate to accomplish and yet prices continue to climb. Mandating renewable energy is in effect mandating higher costs and market inefficiency.

While environmentalists from around the United States hoped Michigan could be the vanguard for a broader national renewable energy policy, Michiganders sent the message loud and clear that costs and benefits matter. America should take notice.

NEW YORK (AP) ? Abercrombie & Fitch Co. delivered a pleasant pre-Christmas surprise to investors: the teen retailer raised its full-year earnings guidance on a strong third-quarter performance, sending shares surging.

The company, based in New Albany, Ohio, reported a 41 percent increase in its net income for the third quarter as international, domestic and direct-to-consumer sales strengthened. Its results beat Wall Street expectations.

The strong quarterly performance is welcome news as A&F has been struggling to sell its preppy jeans and T-shirts when fashion trends are shifting and a rough economy has left teens around the world on tighter budgets. The latest results show that its efforts to fix its merchandise are gaining traction.

Abercrombie & Fitch, which cut prices during the recession, has been working hard to fix its problems. In particular, the company has been reacting more quickly to runway trends, a move that has resonated with shoppers.

"Our merchandise initiatives are taking hold," Mike Jeffries, chairman and CEO told investors on Wednesday. "We're working to become faster and we're doing that with conservative plans, shorter lead times...That's affecting the fashion content of our inventory."

But he cautioned, "With the critical fourth quarter still largely ahead of us and significant macroeconomic uncertainties remaining, we continue to be cautious in our near-term outlook."

The company is also taking a breather in expansion plans. It disclosed in August that it will put a hold on opening any more flagship stores and scale back on the number of locations it opens abroad, in part to prevent stores in international markets from cannibalizing sales from each other.

It announced in June that it was closing 180 U.S. stores over the next few years. The chain had already closed 135 underperforming U.S. stores in two years.

For the period ended Oct. 27, the chain reported net income of $71.5 million, or 87 cents per share, compared with $50.9 million, or 57 cents per share, a year earlier.

Analysts surveyed by FactSet forecast 60 cents per share.

Revenue climbed 8 percent to $1.17 billion from $1.08 billion. Wall Street expected revenue of $1.11 billion.

Direct-to-consumer sales rose 20 percent to $158.3 million. The results include shipping and handling.

Overseas sales increased 37 percent to $351.1 million. Sales in the U.S. were about flat at $818.6 million. The international and U.S. performances include direct-to-consumer sales.

Revenue at stores open at least a year, a key indicator of a retailer's health, fell 3 percent. The figure dropped 4 percent for the Abercrombie & Fitch brand, 3 percent for abercrombie kids and 1 percent for Hollister Co. Analysts had expected an 8.7 percent drop, according to FactSet.

Revenue at stores open at least a year excludes results from stores recently opened or closed.

The company's gross profit margin ? a measure of profitability ? was 62.5 percent, up 2.4 percentage points from a year ago.

For the year, Abercrombie & Fitch anticipates earnings of about $2.85 to $3 per share. Its prior guidance was for earnings between $2.50 and $2.75 per share. Analysts expected earnings of $2.49 per share.

The company said its revised outlook assumes a mid-single digit percentage decline in fourth-quarter revenue at stores open at least a year.

But in midday trading on Wednesday, shares soared $8.07, or nearly 26 percent, to $39.25. At Tuesday's closing price, the company's stock had been down more than 30 percent since the beginning of the year and had lost more than half their value in the past 12 months.

Abercrombie & Fitch had 1,067 stores at quarter's end.
